Administrative Law & Professional Discipline

Peter A. Simm has extensive experience in administrative law and professional discipline. His cases in this field are reported in 22 hardcover law reports, including 3 different cases in the Dominion Law Reports. Simm drafted the factum in all of those cases and, in all but two, also made oral argument as co-counsel or sole counsel. Of the 22 reports, 15 were unequivocal victories and 2 were costs awards in his respective client’s favour.

Simm’s record of success on judicial review has included some exceptional court orders embodying his victories.

Simm has also achieved extraordinarily favourable resolutions before tribunals when defending professionals against disciplinary charges.

Simm’s cases are cited in 5 legal periodicals and 16 leading administrative law textbooks, including a British textbook which rarely cites Canadian cases (De Smith’s Judicial Review,  8th ed., 2018). As well, Simm’s administrative law cases have been cited in 77 appellate court decisions, including by the Supreme Court of Canada and the Irish High Court.

In this area of law, Simm has co-authored (with Lisa Feld) two whole books, two book chapters, and an accredited CPD paper. He is also sole author of a monograph. Simm’s administrative law publications are cited in 8 books (including laudatory citations by the U.S. Dept. of Justice and the Saskatchewan Law Reform Commission) and in 8 journal articles.
