Peter A. Simm was sole counsel for the Applicant for Judicial Review in Fontana (2002, Ont. Div. Ct.). This case, hinging on issues of statutory interpretation, challenged a waiting period for reinstatement of the driver’s license of Simm's client. The Court took more than three months to deliver its reasons. Although Simm’s arguments ultimately did not prevail, the Court expressly noted “there is no question” that the terminology used in the pertinent regulations “is, at time, loose,” and refrained from ordering costs against Simm's client. Fontana is cited in 4 legal textbooks. The Federal Court of Canada has cited this case for a point of administrative law. Full cite: Fontana v.
