Health Law

Depending on the case, Peter A. Simm has acted for, or against, statutorily self-governing health professions. Three hardcover law reports — including the Ontario Reports  — have reported his Health Law cases. In each, he served as winning co-counsel or sole counsel, and researched and wrote the successful factum.

Six Health Law textbooks cite Simm’s cases (including a notable discipline case of interest to, but not directly involving, health professionals).

Simm has been extensively published in the area of health law. With Lisa Feld, he co-authored two books — one of which has been recommended by the U.S. Department of Justice, and the other recommended by the Saskatchewan Law Reform Commission. He also co-authored two book chapters and an accredited CPD paper with Ms. Feld. As well, he was sole author of a monograph, plus co-author of chapter in a research study commissioned by the Federal/Provincial/Territorial Review on Liability & Compensation Issues in Health Care, published by the University of Toronto Press.

Simm’s publications in this field have been cited in 10 books and 8 academic journal articles. He also assisted two other journal articles.

In 2017, in a notable non-litigious health-law matter, Simm successfully advised a group of dissident physicians seeking removal of certain officers of the Ontario Medical Association. His advice was critical in ensuring that the group's proposed resolution of non-confidence would not be disqualified before even coming to a vote at a special general meeting. The resulting resignations of the targeted officers received Ontario-wide and national media attention. (Twelve enlargeable copies of sample media reports are shown below.).
