How Rarely Do JR Applications Succeed?

 

In 2017, the Ontario Divisional Court disposed of 95 applications for judicial review. The Court granted only 14 of those applications, yielding a success rate of merely 14.7%.

The dispositions include not only granting or dismissing a JR application after a full argument on its merits, but also include dismissals without adjudication of the merits, such as dismissals for prematurity or dismissals arising from successful motions to quash a JR application.
