Claussen |
Peter Simm researched and co-drafted the submissions of law for the successful Plaintiff in Claussen (2001) (N.S. S.C.). This case dealt with an oral contract for developing $2 million in land. Addressing the Statute of Frauds, the winning argument also dealt with statutory changes, quantum meruit and unjust enrichment. Seven Canadian legal textbooks cite Claussen, and the trial decision has been judicially cited as recently as 2018. Full cite: Claussen Walters & Associates Ltd. v. Murphy, 2001 NSSC 105, 45 R.P.R.
